Conditions of entry

Policy Statement 

Maitland libraries aim to enable full access to its collections, workspaces and services, and active participation in its programs by the whole community. The libraries are a shared space where everyone is welcome.  

This policy outlines the conduct we expect from members and visitors, both onsite and when interacting with the libraries online. It is based on Library Regulation 2018 made under the Library Act 1939 (NSW)

These Conditions of Entry apply to all Maitland Council library premises, including the immediate vicinity of the building. 

Those entering the library, or its immediate surrounds, must adhere to the following:

  1. General conduct

    1. Respectful behaviour: All library visitors must treat library staff, other visitors, the premises, and items contained therein with respect. Offensive, aggressive or disruptive behaviour will not be tolerated, and the display of offensive imagery or signage is not acceptable.
    2. Inform library staff immediately if you become aware of any risk or potential risk to people or property.
    3. Mobile devices: Mobile phones and other electronic devices should be set to silent mode. Please take phone calls outside the library space when possible.
    4. Quiet spaces: Each library has several spaces designated for use for work, study or other quiet activities. Please maintain respectful volumes in these areas to ensure respect for other library users while in use.
    5. Supervision of children: Children under 12 must be accompanied by a responsible adult (person over the age of 18 and acting in the role of carer).
    6. Attendance on premises: Visitors are only allowed to be on library premises during opening hours and are required to leave the premises when requested at closing time.
  2. Library collection, property and equipment

    1. Copyright: when copying library materials, sharing materials online, downloading resources (including software, films, sound records and broadcasts), you are responsible for observing the provisions of the  Copyright Act 1968 with respect to materials in copyright. 
    2. Care of materials: Handle all library materials (including, but not limited to books, magazines, technology, toys etc.) with care. Items must be returned in the condition they were borrowed.
    3. Furniture and fixtures: Do not move or rearrange furniture without permission. Any damage to furniture, equipment, or facilities must be reported immediately to library staff.
  3. Use of computers, internet and other devices

    1. When using public computers, iPads, or other Council owned devices, including the public Wi-Fi, visitors MUST NOT:
      1. View inappropriate or illegal content.
      2. Download or share illegal content.
    2. Visitors must notify library staff immediately if they become aware of cyber security risk. 
  4. Health and safety

    1. Alcohol and drugs: The consumption or possession of alcohol or illegal drugs on library premises is strictly prohibited.
    2. Smoking: The library is a smoke-free zone (within 10 metres of entrances and/or covered areas), including the use of electronic cigarettes or vaping devices.
    3. Hygiene: Visitors may be asked to leave if their hygiene or cleanliness is disruptive to others.
  5. Safety Protocols

    1. Emergency procedures: In the event of an emergency (or an identified drill related to emergency protocol), follow library staff instructions and exit the building promptly and safely through the marked exits.
    2. Personal belongings: The library is not responsible for lost or stolen personal belongings. Visitors are responsible for not leaving items unattended and personal belongings should not obstruct walkways, or impede on the use of the library by other visitors.
  6. Photography and Recording

    1. Permission required: Professional photography or filming, or images taken for use in any publication, requires prior consent from library manager.
    2. Respect privacy: Images or recordings of other people, including adults and children, must not be taken without prior consent from the individual (and the individual’s parent/guardian, in the case of a child).
  7. Prohibited items

    1. Weapons: Any kind of weapon, or an item resembling a weapon is prohibited.
    2. Pets: Pets are not permitted within the library premises, with the exception of registered service animals.
    3. Hazardous substances: Flammable or dangerous materials are not permitted within the library premises.
  8. Other prohibited activities:

    1. Visitors are prohibited from engaging in the following activities without the prior written consent of library manager:
      1. Undertaking fund raising (including sell raffle tickets)
      2. Distributing a petition or conducting a survey
      3. Displaying signage or promotional materials
  9. Enforcement and Non-Compliance

    1. Consequences: Failure to comply with these conditions of entry may result in a request to leave the library, suspension of library privileges, or, in severe cases, permanent banning.
      1. In the event of dangerous or unlawful behaviour, an immediate ban can be imposed.
      2. In all other instances, written notice of intention to ban will be issued to persons in breach of the conditions together with the opportunity to respond. 
        1. Specific details of the breach will be provided with the notice of intention to ban. The delegated council officer will properly consider any response received to the proposed ban before making any decision.
        2. A person who enters any Maitland library premises while they are under a ban is trespassing.
